The police are very likely recording how you\u2019re driving, so take care to follow all traffic laws.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"2_Stay_Calm\"><\/span>2. Stay Calm<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>You\u2019re likely to feel anxious as the officer approaches the car, but stay calm and polite. Remember that the police are still probably recording you. The last thing you want is to give the impression that you are drunk, rude, or uncooperative.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"3_Exercise_Your_Right_to_Remain_Silent\"><\/span>3. Exercise Your Right to Remain Silent<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>When the officer asks, provide your name, address, drivers\u2019 license, and car registration, and insurance information. Otherwise, remember that you have the Constitutional right to remain silent. This right means that you can refuse to answer incriminating questions, such as \u201cHow much have you had to drink?\u201d or even \u201cBig party night?\u201d<\/p>\n<h4><span class=\"ez-toc-section\" id=\"4_Consider_Whether_to_Refuse_a_Field_Sobriety_Test_or_Chemical_Test\"><\/span>4. Consider Whether to Refuse a Field Sobriety Test or Chemical Test<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>The officer may ask you to perform a Field Sobriety Test. In Indiana, you have the right to refuse to take these tests without legal consequences. Simply tell the police officer your lawyer has told you to never to agree to such tests. However, under Indiana law having a drivers\u2019 license gives implied consent to take a chemical test, such as a Breathalyzer. If you decide to refuse to take it anyway, you\u2019ll face having your drivers\u2019 license suspended for one year\u2013and you can still get charged with an OWI.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"DONT\"><\/span>DON\u2019T<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4><span class=\"ez-toc-section\" id=\"1_Be_Argumentative\"><\/span>1. Be Argumentative<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Arguing with a police officer will get you absolutely nowhere, even if the police officer is wrong. Even if you haven\u2019t been drinking, starting an argument may give an officer reason to think that you have been.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"2_Admit_to_Drinking\"><\/span>2. Admit to Drinking<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Never admit to drinking, even if you had a single glass of wine. Some people think that volunteering such information will help their case or show that they\u2019re being cooperative. But it can hurt more than it helps. Don\u2019t lie\u2013just remain silent if asked whether you\u2019ve been drinking.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"3_Dont_make_any_further_statements_if_arrested\"><\/span>3. Don\u2019t make any further statements if arrested<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>If you are arrested for DUI, make no further statements following the arrest. Most police cars have microphones or video recorders. Assume the police are recording everything you say and that they\u2019ll hold anything even slightly incriminating against you.
