Any time you purchase a firearm or apply for a handgun license in Indiana, you need to make sure that you provide accurate information. The consequences if you do not can be severe – including a prison term of up to 6 years and a fine of up to $10,000. Your firearm can be confiscated as well.
Many handgun owners in Indiana apply for a license to make it easier for them to travel with their handguns to other states that do not share Indiana’s so-called “constitutional carry” laws. In addition, gun purchases made from licensed dealers involve federal background checks, and you need to provide a valid Indiana license or state ID that shows your current home address.
Here is the problem: If you provide any false information on either the handgun license application or the firearm purchase documentation, you could be violating Indiana law and could be charged with a Level 5 felony. The same applies if you use a fake ID to buy a gun or to apply for a handgun license.
That’s because Indiana makes it illegal to provide “false information” on any form that is required to either apply for a handgun license or to purchase a firearm.
Fortunately, this law also requires you to “knowingly or intentionally” provide the false information. That means it is a defense to a charge under this law if you mistakenly gave false information.
You need to be careful whenever you apply for a handgun license or purchase a firearm and are asked to fill out a form – usually a federal Form 4473 – in connection with the required background check. If your driver’s license, for example, lists an old address, you could face allegations that you were trying to provide false information.
