What is Sextortion?

Sextortion is a form of digital blackmail. It typically involves the perpetrator threatening to distribute real or AI-generated nude images of the victim online unless the victim agrees to do something, such as send the perpetrator actual nude images or pay the perpetrator money. Victims are often embarrassed to find themselves targeted for sextortion, and as a result, many sextortion schemes go unreported.

Types of Sextortion

 

In some cases, sextortion perpetrators may know their victims. The perpetrator and the victim may have been in a relationship, one that included the consensual exchange of nude images or videos. When the relationship ends, one party may threaten to distribute images of the other – unless the victim agrees to certain demands, which can include any number of things.

In other cases, the sextortion perpetrator is a stranger, and the only connection between the perpetrator and the victim may be online. The perpetrator will typically seek out the victim online, initiating contact and starting an ongoing conversation. They may gradually lead the victim into sharing compromising images or videos, or the perpetrator may use AI or other types of editing tools to generate nude images or videos from ordinary online images of the victim. The perpetrator will threaten to share the generated images – even though they are fakes – with the victim’s friends or family or will threaten to post the images in a public forum unless the victim does what the perpetrator is asking.

Sextortion is Illegal

 

Sextortion can be illegal on a number of levels.

Where the victim is under the age of 18, the exchange of nude images can constitute a sex crime that can result in the perpetrator being sent to prison for years or decades. By threatening to distribute nude images or videos of a victim who is under the age of 18, the defendant can be charged with a Level 6 felony. Simply possessing the images can result in a Child exploitation charge if the victim is under the age of 18, which can be a Level 5 felony or, in some cases, a Level 4 felony.

Sextortion can also be charged as a form of extortion, a crime which is called “Intimidation” in Indiana. Intimidation is when the perpetrator “communicates a threat” with the intent that the victim “engages in conduct against” their will. A “threat” can include expressing “an intention” to “expose the person threatened to hatred, contempt, disgrace, or ridicule.” Intimidation victims can be of any age. It is a Class A misdemeanor.
