New Indiana Law Targets AI-Generated Revenge Porn

A new Indiana law that went into effect on July 1, 2024, adds images generated by artificial intelligence to the list of “intimate images” of an individual that cannot be distributed without that person’s consent. The purpose of the law is to protect people targeted by so-called “revenge porn,” typically a situation where nude images or videos of someone are circulated by a former friend or someone they were in a relationship with.

Prohibited AI-Generated Images

What’s typically different about images or videos generated by artificial intelligence is that they may not start with an actual image of the person, or they may begin with an actual image of the person and then transform the image well beyond what the original looked like.

As a simple example, artificial intelligence tools are able to remove the clothes from an original picture of someone and depict the person in the nude. AI tools can also create a “look-alike” image based solely on text prompts given to the AI system by the user.

How the Indiana Law Defines the Prohibited Images

The new Indiana law prohibiting circulation of AI-generated “intimate images” broadly defines the types of images that cannot be distributed without consent as follows:

  • a “photograph, digital image, computer-generated image, or video of an individual;”
  • that is “created or modified by means of a computer software program, artificial intelligence, application, or other digital editing tools;”
  • that “appears to depict the alleged victim.”

The law applies not only to AI-generated images but also to any other image that has been created or modified using a computer or an app.

What the Indiana Law Prohibits

Essentially, the so-called “revenge porn” law prohibits the distribution of intimate images and videos that appear to look like another person – whether actual images, modified images, or images created using artificial intelligence or a computer program – without that person’s consent. Violation of the law is a Class A misdemeanor, with a possible penalty of up to one year in county jail and a $5000 fine. If the defendant has a prior conviction under the law, the new offense is a Level 6 felony, with penalties of up to 2 years in prison and a $10,000 fine.
